   Appeal Cases

   Any person can file APPEAL against the order passed by a Revenue Officer in any proceeding under any section of law as per WBLR Act, 1955 to the appropriate appellate authority as prescribed in WBEA Act, 1953 and WBLR Act, 1955.

  • Vesting cases u/s 14T(3)/(3A)/(5)/(6) under section 14T(7) read with section 54 of WBLR Act, 1955 as envisaged in section 14T(7) of the said act.
  • Vesting cases under any other section of Chapter IIB shall be u/s 54 of WBLR Act, 1955.
  • Termination of cultivation by a Bargadar u/s 17, decisions of Revenue Officer u/s 18(1) relating to division/delivery of produce, recovery of produce u/s 16A, termination of cultivation by the Bargadar u/s 18(2), disputes relating  to identity on a Bargadar or to whom share should be delivered and findings of Revenue Officer in references made by Civil Court u/s 21(3) should be dealt under section 19 of the WBLR Act, 1955 read with rules 7, 8, 11 and 12 of WBLR (Bargadar) Rules, 1956.
  • Appeal against order of Revenue Officer u/s 19B shall be dealt with 19B(2) of WBLR Act, 1955.
  • Appeal against order (s) of Revenue Officer u/s 15A regarding continuation of right of cultivation on bargadar’s death u/s 20B, surrender on abandonment by Bargadar u/s 21D shall be disposed u/s 54 of WBLR Act, 1955.
  • Appeal u/s 51A(5) shall only lie against an order passed u/s 51A(4) only.
  • No appeal shall be entertained on orders passed u/s 51A(1) and shall be dismissed as premature.
  • Appeal against order (s) passed u/s 49(2) shall be made u/s 49(4).
